Terms of Service

As an organization choosing to participate and collaborate as a benefiting partner, One Valley Community Foundation (One Valley), the host of Give Big Gallatin Valley (Give Big), requires that you enter into this Acknowledgement of Terms of Service (Acknowledgment). This Acknowledgment sets forth the services to be provided by One Valley and the duties, roles, and responsibilities of all Give Big participants.

  1. I represent and warrant that my organization is a 501(c)(3) or is fiscally sponsored by a 501(c)(3), is in good standing with the IRS, and will provide our EIN for verification.
  2. I represent and warrant that my organization is located in and/or serving Gallatin County, MT.
  3. I understand that One Valley hosts Give Big but is not responsible for the amount of money contributed to my organization through the initiative. Donors choose where to place their gifts, and One Valley does not control this process. A participation fee refund will not be issued based on my organization’s performance.
  4. I agree to focus the majority of my organization’s marketing efforts in the days leading up to Give Big on helping build excitement among donors, volunteers, media, and fellow nonprofits.
  5. I understand that any events my organization hosts during Give Big are organized independently by my organization. One Valley is not responsible for any such events. I acknowledge that One Valley’s insurance policy only covers its own liability. If my organization hosts an event, we are solely responsible for securing appropriate insurance coverage.
  6. In consideration for my organization’s ability to participate in Give Big, my organization fully and forever releases and discharges One Valley, including its employees, directors, officers, representatives, successors, assigns, agents, partners, employees, insurers, and attorneys, from any claims, actions, demands, or expenses arising out of any events hosted by my organization in connection with Give Big. My organization agrees to hold harmless and defend One Valley from any claims or liability arising from the same.
  7. I understand that only one organization may register per EIN, except in cases where multiple fiscally sponsored programs operate under the same fiscal sponsor’s EIN.
  8. I understand that all donations associated with Give Big must be made through GiveBigGV.org, via check, wire, or DAF transfer directly to my organization, or through One Valley. To count as a Give Big donation, the gift must be explicitly designated for Give Big by the donor.
  9. I agree that any offline gifts uploaded through my organization’s administrative dashboard are subject to verification by One Valley. If my organization cannot provide proof of the offline gift, we will be required to remove it from our profile.
  10. I understand that only donations made through GiveBigGV.org will count toward any prizes offered as part of the 24 hour initiative.
  11. I understand that by participating in Give Big, my organization, volunteers, supporters, and staff consent to be photographed, filmed, and recorded, and grant One Valley unrestricted, royalty-free use of such content, free of charge.
  12. I understand that if asked to participate in interviews with newspaper, TV, or radio, I speak on behalf of my organization and agree to promote the community-wide spirit of Give Big.
  13. I understand that GiveGab.com is an online platform that will safely process all donor contributions made to the event.
  14. I understand that all online donations will be disbursed within 5 to 7 business days via electronic funds transfer, minus transaction fees. I understand that if I do not provide routing information for automatic transfer, my organization cannot participate.
  15. I understand that all funds donated through One Valley and any prizes won by my organization will be distributed via check from One Valley. My organization is responsible for receiving and depositing this check in a timely manner. Any checks not deposited within six months of issuance will be voided, and funds will return to One Valley.
  16. I understand that my organization is prohibited from donating to itself or to any programs it fiscally sponsors.
  17. I understand that my organization is not permitted to run Google Search Ads using the keyword or variations of "Give Big Gallatin Valley" between April 15 and May 5, to ensure the Give Big site maintains priority in search results.
  18. I understand and agree that One Valley is not responsible for malfunctions of the Give Big platform, including service interruptions, lost data, donation accounting errors, or software malfunctions. My organization assumes all risks associated with participation and agrees to hold One Valley harmless from liability arising from such issues.
  19. I agree that my organization’s communications related to its participation in Give Big will align with the terms and spirit of the Give Big initiative.
  20. One Valley claims proprietary rights to the Give Big servicemark and logo. One Valley grants my organization a revocable, limited, royalty-free license to use the Give Big servicemark and logo in connection with promoting Give Big and my organization’s sponsored events. My organization agrees to use the servicemark and logo only as provided, only during the three months preceding Give Big, and without alteration of colors, proportions, or design elements. My organization may not grant licenses to others.
  21. I understand that Give Big is an initiative that supports and celebrates all Gallatin County nonprofits. My organization agrees to uphold this spirit by refraining from derogatory, inflammatory, or combative language in reference to other nonprofits or any other entity in its Give Big materials or profile.
  22. I agree to attempt to resolve any dispute arising from or related to this Acknowledgment or Give Big through mediation before pursuing legal action against One Valley or its officers, directors, representatives, affiliates, partners, or service providers.
  23. I agree to maintain an atmosphere free of discriminatory, harassing, coercive, or disruptive conduct, including sexual harassment, in all interactions with One Valley staff and representatives. Prohibited harassment includes unwelcome actions, words, jokes, or comments based on legally protected characteristics.
  24. I agree to promptly notify One Valley of any changes to my organization’s eligibility status after being approved to participate, including changes to 501(c)(3) status, fiscal sponsorship, or service area.
  25. I represent and warrant that my organization does not support, incite, or engage in hateful activities, as defined in One Valley Community Foundation’s Values Aligned Grantmaking Policy. Such activities are contrary to One Valley Community Foundation’s charitable purpose and vision. While there is no universally accepted definition of what constitutes hateful activities, One Valley relies on data crosschecked from a variety of external sources to identify organizations that may fall into these categories and reserves the right to disqualify any organization from participating in Give Big or receiving funds, consistent with the terms of this Acknowledgement.
  26. I represent and warrant that I have the authority to bind my organization to this Acknowledgment. I understand that One Valley reserves the right to disqualify any organization from participating in Give Big and from receiving prize dollars if it determines a breach of terms or deception has occurred. My organization fully and forever releases and discharges One Valley from any claims arising out of such disqualification. Disqualification revokes all licenses granted under this Acknowledgment but does not extinguish the releases, waivers, or hold harmless obligations outlined above.
